Het coronavirus en de btw

Wij hoeven hier niet te herhalen dat het coronavirus op allerlei manieren impact heeft op de samenleving en ondernemingen. We zien nu in de praktijk dat liquiditeitsproblemen wellicht de meest urgente issues zijn waar ondernemers mee kampen. Eerder hebben we al bericht over de noodmaatregelen die het kabinet hiervoor heeft genomen. Uitstel van betaling voor belastingen, waaronder de btw, is er één van. Verdere maatregelen op het terrein van de omzetbelasting zijn er nog niet. Nu zou je kunnen denken: minder omzet betekent ook minder te betalen btw, maar dat is te kort door de bocht. Maar ondernemers kunnen wel gebruik maken van bestaande regelingen om btw terug te vragen, en daardoor op korte termijn hun liquiditeitspositie verbeteren.

 

Annuleringen

Veel ondernemers worden op dit moment geconfronteerd met annuleringen. Door btw terug te vragen, kan de schade hiervan enigszins beperkt worden. Maar hoe werkt dat ook al weer? Hieronder lichten wij dit toe voor drie situaties:

  1. De klant krijgt het volledig betaalde bedrag terug;
  2. De klant betaalt gedeeltelijk;
  3. De klant betaalt volledig.

Ad 1. De klant krijgt het volledige betaalde bedrag terug
Als je bij een annulering de klant zijn volledige betaling terugbetaald, kun je het btw-bedrag, als je dat al op je btw-aangifte hebt voldaan, terugvragen. Hier zijn wel voorwaarden aan verbonden. Als je deze prestatie al hebt gefactureerd, dan is de beste manier om een creditfactuur uit te reiken.

Bij een zakelijke klant is het goed om te overleggen met de klant om zekerheid te krijgen dat de klant de btw niet al in aftrek heeft gebracht of de btw zal restitueren, voordat je het btw-bedrag terug vraagt.

Ad 2. De klant betaalt gedeeltelijk
Als de klant een gedeeltelijke restitutie van het betaalde bedrag krijgt, dan gelden dezelfde regels als wanneer je het volledige bedrag terugbetaald.

Het kan bijvoorbeeld zo zijn dat de klant al een gedeelte (een voorschot bijvoorbeeld) heeft betaald, of dat je een extra bedrag aan de klant in rekening brengt wegens de annulering. Het is aan te raden om deze betalingen nog eens goed onder de loep te nemen. Is de betaling van de klant een vorm van schadevergoeding vanwege het feit dat de klant niet afneemt, of is het een vergoeding voor de prestatie waarop de klant recht had, maar die hij niet afneemt? Het onderscheid tussen deze twee is volgens jurisprudentie dat er over een zuivere schadevergoeding geen btw verschuldigd is. Dan kun je de btw die je reeds hebt voldaan onder voorwaarden terugvragen.

Als de betaling een vergoeding vormde voor een niet afgenomen prestatie, dan is er wel btw verschuldigd. Uit de vele jurisprudentie over dit onderwerp volgt dat het een dunne scheidslijn is die bepaalt of er wel of geen btw verschuldigd is. Ook wordt de materie zeer feitelijk beoordeeld.

Ad 3. De klant betaalt volledig
Als de klant toch het volledige bedrag betaalt, betekent dat niet dat je automatisch het volledige btw-bedrag moet voldoen. Ook hier kan de betaling door de klant namelijk als schadevergoeding worden gezien, wat zorgt voor een mogelijkheid om de btw terug te vragen. En ook hier geldt dat wanneer de betaling een vergoeding is voor een prestatie die niet is afgenomen, er btw verschuldigd blijft. Hierbij maken we ook de kanttekening dat uit de jurisprudentie blijkt dat het feit dat een klant volledig betaalt door rechters vaak als omstandigheid wordt gezien die leidt tot btw-belastbaarheid.

Wat te doen bij veel annuleringen?
Annuleringen zijn uiteraard erg vervelend, maar de financiële schade is dus misschien nog een beetje te beperken. Als je met veel annuleringen te maken hebt, kun je altijd contact zoeken met een van onze btw-adviseurs. Wij helpen je graag!

Kortingen

Desperate times ask for desperate measures. Veel ondernemers voeren op dit moment speciale acties om klanten te blijven binden, vaak in de vorm van kortingen.

Als je een korting geeft, kan het zo zijn dat je btw kunt terugvragen. Bij kortingen die vooraf worden gegeven wordt er uiteraard geen btw over de korting berekend. Maar bij kortingen achteraf bestaat wel de mogelijkheid om de btw over het kortingsbedrag terug te vragen.

Ook hier is het zo dat overleg met een zakelijke klant aan te raden is. Voordat je de btw terugvraagt moet je de zekerheid hebben dat de klant de btw over het kortingsbedrag niet in aftrek brengt of zal restitueren.

Oninbare vorderingen

Let vanwege je liquiditeitspositie nu ook extra goed op de niet betalende klanten. Indien je de btw al hebt voldaan en je klant betaalt de factuur niet, kun je ook de btw terugvragen. Dit kan in het tijdvak waarin vast komt te staan dat je factuur niet is betaald en dat ook niet meer gaat gebeuren. Verder geldt dat de btw in ieder geval terug kan worden gevraagd na een periode van één jaar nadat de factuur is gestuurd.

Wij zouden ons hierbij als extra steunmaatregel kunnen voorstellen dat de hierboven genoemde periode van één jaar wordt teruggebracht naar één kwartaal. Er hoeft dan niet een heel jaar te worden gewacht op de btw-teruggaaf, en dat scheelt weer!

Steunmaatregelen in de btw

Ook zou het terugbrengen van de termijn van oninbare vorderingen naar een kwartaal een volgens ons een goede mogelijkheid zijn voor een steunmaatregel.

Ondernemers kunnen nu al uitstel van betaling krijgen voor de te betalen btw, maar dat is slechts een begin. Uitstel van een volledig kwartaal zou veel ondernemers lucht geven. De meeste Nederlandse ondernemers doen aangifte per kwartaal en in april moet de eerste aangifte 2020 al worden gedaan. Ondertussen lopen de debiteurenstanden op, facturen worden trager betaald. Daarom pleitten wij ervoor dat ondernemers een kwartaal extra moeten krijgen voor het betalen van hun btw. We wachten het af!

We do not need to repeat here that the coronavirus has an impact on society and businesses in many ways. We now see that liquidity problems are perhaps the most pressing issues facing entrepreneurs. We have already reported on the emergency measures taken by the government in this regard: postponement of payment of taxes, including VAT, is one of them. There are no further measures in the field of turnover tax yet. Now you might think: less turnover also means less VAT to pay, but that’s not entirely true. But entrepreneurs cán make use of existing schemes to reclaim VAT, thereby improving their liquidity position in the short term.

Cancellations

Many entrepreneurs are currently faced with cancellations. By reclaiming VAT, the damage can be limited to some extent. But how does that work again? Below we explain this for three situations:

The customer gets the full amount paid back;
The customer pays partially;
The customer pays in full.

Re 1. The customer gets the full amount paid back
In the event of a cancellation where the customer gets his money back, you can reclaim the VAT amount, if you have already paid it on your VAT return. However, there are conditions attached to this. If you have already invoiced this service, the best way to do this is to issue a credit invoice.

In the case of a business customer, it is good to consult with them to be sure that they have not already deducted the VAT or will refund the VAT before you reclaim the VAT amount.

Re 2. The customer pays partially
If the customer receives a partial refund of the amount paid, the same rules apply as when you refund the full amount.

It may be the case that the customer has already paid a part (an advance payment, for example), or that you charge an additional amount to the customer due to the cancellation. It is advisable to take a closer look at these payments. Is the customer’s payment a form of compensation due to the fact that the customer does not purchase, or is it compensation for the service to which the customer was entitled, but which he does not purchase? The distinction between the two, according to case law, is that no VAT is due on pure compensation. In that case, you can reclaim the VAT that you have already paid under certain conditions.

If the payment was compensation for a service that was not purchased, then VAT is due. It follows from the many case law on this subject that it is a thin dividing line that determines whether or not VAT is due. The matter is also assessed on a very factual basis.

Re 3. The customer pays in full
If the customer still pays the full amount, this does not mean that you automatically have to pay the full amount of VAT. In this case, too, the customer’s payment can be seen as compensation, which provides an opportunity to reclaim the VAT. And again, if the payment is a compensation for a service that has not been purchased, VAT remains due. It should also be noted that case law has shown that the fact that a customer pays in full is often regarded by judges as a circumstance that leads to VAT liability.

What to do in the case of many cancellations?
Cancellations are of course very annoying, but the financial loss can perhaps still be limited a little. If you have to deal with many cancellations, you can always contact one of our VAT advisors. We are happy to help you!

Discounts

Desperate times ask for desperate measures. Many entrepreneurs are currently carrying out special actions to maintain customer loyalty, often in the form of discounts.

If you give a discount, you may be able to reclaim VAT. Of course, when discounts are given in advance, no VAT is calculated on the discount. However, in the case of subsequent discounts, it is possible to reclaim the VAT on the discount amount.

Again, consultation with a business customer is recommended. Before reclaiming the VAT, you need to be sure that the customer does not deduct or will not refund the VAT on the discount amount.

Irrecoverable claims

Because of your liquidity position, pay extra attention to non-paying customers. If you have already paid the VAT and your customer does not pay the invoice, you can also reclaim the VAT. This can be done in the period in which it is established that your invoice has not been paid and is not going to. Furthermore, the VAT can in any case be reclaimed after a period of one year after the invoice has been sent.

As an extra support measure, we could imagine that the above-mentioned period of one year would be reduced to one quarter. Then you don’t have to wait a whole year for the VAT refund, which already makes a difference.

VAT support measures

Reducing the period of bad debts to a quarter would also, in our view, be a good option for an aid measure.

Entrepreneurs can already obtain a deferral of payment for the VAT to be paid, but that is only a start. Postponing a full quarter would give many entrepreneurs some air. Most Dutch entrepreneurs file their returns on a quarterly basis and the first returns for 2020 must be filed in April. Meanwhile, accounts receivable are rising, invoices are being paid more slowly. That is why we think that entrepreneurs should be given an extra quarter to pay their VAT. We will see!
